Terms of Service

These Terms of Service (“Terms”) govern your access to and use of EditTextImage (the “Service”), operated by SparkTech. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Accounts

You must sign in with a Google account to use the Service. You are responsible for safeguarding access to your account and for all activity under it. You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account.

2. Credits, payments, and refunds

Each new account receives 2 free credits. One credit is consumed per successful text-edit generation.
Credits are purchased through Stripe in non-refundable one-time packs. Credits do not expire.
If a generation fails for technical reasons, the consumed credit is automatically refunded to your balance.
We do not provide cash refunds for credits that have already been successfully used, or for credits consumed on requests that violate the Acceptable Use Policy.
Prices and pack sizes may change at any time.

3. Acceptable use

You agree not to upload or request edits to content prohibited by our Acceptable Use Policy. Prohibited content includes, without limitation:

Copyrighted works you do not own or have permission to modify.
Government-issued IDs, passports, driver’s licenses, diplomas, contracts with official seals or signatures, notarized documents, bank statements, tax forms, and similar official documents.
Currency, checks, bonds, and other financial instruments.
NSFW, sexual, or violent content, and any sexualized content involving minors (absolutely prohibited).
Deceptive alterations of real people (e.g. fake quotes on news screenshots, fabricated social-media posts) intended to mislead viewers.
Content used for fraud, impersonation, harassment, hate speech, threats, doxxing, or to promote illegal goods and services.

We may, without prior notice, delete offending content, suspend or terminate your account, withhold refunds for violating requests, and cooperate with law-enforcement requests.

4. Your content and ownership

You retain all rights you have in the images you upload (“Inputs”) and, subject to your compliance with these Terms, you own the edited images you generate (“Outputs”). You grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, and transmit your Inputs and Outputs solely for the purpose of operating, securing, and improving the Service.

You represent and warrant that you have all rights, permissions, and consents necessary to upload the Inputs and to generate and use the Outputs. We make no ownership claim over your Outputs and do not use them to train generative models.

5. AI-generated output

Outputs are produced by third-party AI models. Given the nature of generative AI, results may contain errors, artifacts, or unintended text. You are solely responsible for reviewing Outputs before using them, especially in commercial, legal, medical, or safety-critical contexts. The Service is provided on an “as is” and “as available” basis without warranties of any kind.

6. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by SparkTech and protected by intellectual- property laws. You may not copy, modify, reverse-engineer, or create derivative works of the Service, nor use automated means to scrape or overload it.

7. Third-party services

The Service relies on third-party providers including Google (authentication), Stripe (payments), Cloudflare R2 (storage), and generative-AI model providers. Your use of those components is also subject to their respective terms.

8. Suspension and termination

We may suspend or terminate your access at any time for violation of these Terms, for suspected fraud or abuse, or as required by law. Sections addressing ownership, disclaimers, indemnity, and limitation of liability survive termination.

9. Disclaimer of warranties

To the maximum extent permitted by law, SparkTech disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that Outputs are error-free, lawful in your jurisdiction, or suitable for any particular use.

10. Limitation of liability

To the maximum extent permitted by law, SparkTech and its affiliates will not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for lost profits, goodwill, data, or other intangible losses, arising out of or related to your use of the Service. Our aggregate liability for any claim will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or USD 50, whichever is greater.

11. Indemnity

You agree to indemnify and hold harmless SparkTech, its affiliates, and their respective personnel from any claim, loss, or expense (including reasonable legal fees) arising out of your Inputs, your Outputs, your violation of these Terms, or your violation of any law or third-party right.

12. Changes

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
